This Cookie Policy ("Cookie Policy") explains how My Opus, Inc. ("Opus," "Company," "we," "us," or "our") and our authorized service providers use cookies, pixels, software development kits, and similar tracking technologies (collectively, "Cookies and Similar Technologies") in connection with the Opus services, including the Opus mobile application, the Opus website at opuswithin.com (and any related subdomains), the Opus web application, and any other digital property that links to or references this Cookie Policy (collectively, the "Services").

This Cookie Policy supplements, and forms part of, our Privacy Policy. Capitalized terms used but not defined in this Cookie Policy have the meanings given to them in our Terms of Use or our Privacy Policy, as applicable.

1. What Are Cookies and Similar Technologies?

1.1 Cookies

A "cookie" is a small text file that a website or application places on your device (such as a computer, smartphone, or tablet) when you visit or use the website or application. Cookies enable a website or application to recognize your device and to remember information about your visit, such as your preferences and settings.

Cookies may be:

(a) Session cookies, which are deleted when you close your browser; or

(b) Persistent cookies, which remain on your device for a defined period of time or until you delete them.

1.2 Similar Technologies

In addition to cookies, we and our service providers may use the following similar technologies:

(a) Pixels (also known as web beacons or tracking pixels), which are small graphic images embedded in web pages or emails that allow us to recognize when a page has been viewed or an email has been opened;

(b) Local storage, including HTML5 local storage, IndexedDB, and similar mechanisms, which allow websites and applications to store information locally on your device;

(c) Software development kits (SDKs), which are pieces of software code embedded in our mobile application that perform functions analogous to cookies (such as device identification, analytics, and crash reporting);

(d) Device identifiers, including Apple's Identifier for Advertisers (IDFA), Google's Advertising ID (AAID), and similar persistent identifiers; and

(e) Other tracking technologies that perform functions analogous to those described above.

For convenience, we refer to all of these technologies in this Cookie Policy as "Cookies and Similar Technologies" or simply "Cookies."

2. Categories of Cookies and Similar Technologies We Use

We use Cookies and Similar Technologies that fall within the following categories. The specific Cookies in each category are listed in the cookie inventory referenced in Section 7 (Cookie Inventory) and managed through our consent management platform.

2.1 Strictly Necessary Cookies

Strictly Necessary Cookies are essential for the operation of the Services. They enable core functionality such as authenticating you to your account, maintaining the security of the Services, supporting load balancing, remembering your cookie preferences, and providing the basic functionality you have requested. Without these Cookies, the Services cannot function properly.

Because these Cookies are strictly necessary to deliver the Services, you cannot opt out of them through our consent management platform. You may still block or delete them through your browser settings, but doing so may impair your ability to use the Services.

The legal basis for our use of Strictly Necessary Cookies is, where applicable, our legitimate interest in providing the Services and, in the European Economic Area, the United Kingdom, and Switzerland, the exemption for cookies that are strictly necessary for the provision of an information society service explicitly requested by the user under Article 5(3) of the ePrivacy Directive (and the implementing national laws thereof).

2.2 Functional Cookies

Functional Cookies allow the Services to remember choices you make (such as your language, region, time zone, and other preferences) and provide enhanced, more personal features. These Cookies may be set by us or by third-party service providers whose services we have added to our pages.

Functional Cookies are not strictly necessary, but they enhance the functionality and personalization of the Services. You may disable Functional Cookies through our consent management platform, in which case some or all of the affected functions may not work properly.

2.3 Analytics and Performance Cookies

Analytics and Performance Cookies allow us and our analytics service providers to count visits and traffic sources, to measure and improve the performance of the Services, to understand how Users interact with the Services, and to measure the effectiveness of our marketing channels. They help us know which pages, features, and content are most and least popular and how visitors move through the Services. We currently use customer data infrastructure tools (including Segment) to route analytics data to selected analytics providers (such as PostHog and Google Analytics) for these purposes.

All information collected by Analytics and Performance Cookies is aggregated and, where reasonably practicable, processed in a manner that does not directly identify individual Users. If you opt out of Analytics and Performance Cookies, we will not be able to count your visit or measure your interactions in our analytics, and our ability to identify and resolve performance issues affecting your experience may be limited.

2.4 Marketing and Advertising Cookies

Marketing and Advertising Cookies may be used by us or by our advertising partners to build a profile of your interests, to deliver targeted advertising on our Services or on other websites, and to deliver cross-context behavioral advertising as defined under applicable U.S. state privacy laws.

As of the Effective Date, we do not use Marketing and Advertising Cookies on the Services. We will update this Cookie Policy and provide an opt-out mechanism through our consent management platform if and when we begin to use Marketing and Advertising Cookies. If activated, these Cookies will be subject to your prior opt-in consent in jurisdictions that require it (including the European Economic Area, the United Kingdom, and Switzerland) and to your right to opt out in jurisdictions that provide a right to opt out of sale or sharing of personal information for cross-context behavioral advertising (including California, Colorado, Connecticut, Virginia, and other applicable U.S. states).

Marketing analytics — what we do use. Although we do not use cookies for targeted advertising, we do use marketing analytics tools to measure the effectiveness of our marketing channels (such as understanding which marketing pages led visitors to sign up). These tools, which may include Google Analytics (deployed via Segment) and similar measurement-only tools, are categorized as Analytics and Performance Cookies under Section 2.3 (Analytics and Performance Cookies) and are subject to the consent and opt-out controls applicable to that category. We do not use these tools to deliver advertising to you on other websites and we do not authorize their providers to use the information they collect for their own advertising purposes.

Social Media Cookies are set by social media services (such as platforms used for marketing or content distribution) that may be integrated with the Services or our marketing site. They may be used to enable you to share content from our Services, to track your interactions with social media features, or to provide measurement data to those platforms. Social Media Cookies are governed by the privacy policies of the applicable social media providers.

3. First-Party and Third-Party Cookies

3.1 First-Party Cookies

"First-Party Cookies" are Cookies set by us directly. We use First-Party Cookies to operate, secure, and personalize the Services.

3.2 Third-Party Cookies

"Third-Party Cookies" are Cookies set by third-party service providers we have engaged to provide certain functions on our behalf, including analytics, error monitoring, authentication, customer support, and (where applicable) communications. These third parties may use the information collected through their Cookies for the purposes described in their own privacy policies.

The categories of third parties whose Cookies may be set on the Services correspond to the categories of subprocessors described in Section 6.1 (Service Providers and Subprocessors) of our Privacy Policy. A current list of specific subprocessors is available at our Subprocessor List.

We do not control how these third parties use the information collected through their Cookies. We encourage you to review the privacy policies of any third parties whose Cookies are set through the Services.

4. How We Use Cookies and Similar Technologies

We use Cookies and Similar Technologies for the following purposes:

(a) Authentication and Security: To recognize you when you log in, to keep your session secure, and to protect against fraud, abuse, and unauthorized access;

(b) Functionality and Preferences: To remember your settings, preferences, and selections;

(c) Performance and Analytics: To understand how Users interact with the Services, to measure performance, to identify and resolve issues, and to inform improvements to the Services;

(d) Personalization: To deliver content tailored to you based on your interactions with the Services;

(e) Communications: To support delivery of email and (where you have consented) push and text messages, and to measure engagement with our communications;

(f) Compliance: To support our compliance with applicable laws, including by recording your cookie preferences and consents; and

(g) Such other purposes as may be described to you at the time the relevant Cookie or Similar Technology is used.

5. Your Choices and Controls

We use a consent management platform to allow you to manage your preferences regarding Cookies and Similar Technologies. When you first visit our website, and from time to time thereafter, you will be presented with a banner or interface allowing you to:

(a) accept all Cookies; (b) reject all non-essential Cookies; or (c) customize your preferences by category.

You can revisit your preferences at any time through the consent management interface, which is accessible from our marketing site (typically through a "Cookie Preferences" or similar link in the footer).

5.2 Browser Controls

In addition to our consent management platform, most web browsers allow you to manage Cookies through your browser settings. You can typically configure your browser to:

5.3 Mobile Device Controls

On mobile devices, you can manage advertising identifiers and similar device-level settings through your device's settings menu:

(a) iOS: Settings → Privacy & Security → Tracking, and Settings → Privacy & Security → Apple Advertising;

(b) Android: Settings → Privacy → Ads (or, on some devices, Settings → Google → Ads).

You can also reset or limit the use of advertising identifiers through these menus.

5.4 Push Notification Controls

Push notifications are not set or stored as Cookies, but can be controlled through your device's notification settings or, where available, through your account settings within the Services.

5.5 Opt-Out for Specific Service Providers

Some of the third-party service providers whose Cookies we use may offer their own opt-out mechanisms. Where applicable, these will be linked from our consent management platform or our Subprocessor List.

5.6 Effect of Withdrawal

You may withdraw your consent to non-essential Cookies at any time through the mechanisms described in this Section 5. Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of your consent before its withdrawal.

6. Global Privacy Control and "Do Not Track" Signals

6.1 Global Privacy Control (GPC)

Some web browsers offer a "Global Privacy Control" or "GPC" signal, which is a setting that communicates a user's privacy preferences to websites the user visits. Where you visit our Services from a browser or browser extension that transmits a GPC signal, we treat that signal as a valid request to opt out of the sale or sharing of personal information for cross-context behavioral advertising for that browser or device, to the extent required by applicable law (including the California Consumer Privacy Act, as amended).

Because we do not currently sell personal information or share personal information for cross-context behavioral advertising, GPC signals do not currently change our practices with respect to your personal information. If our practices change in the future, we will honor GPC signals as required by applicable law.

6.2 "Do Not Track" Signals

Some web browsers offer a "Do Not Track" or "DNT" setting. There is currently no industry-wide consensus on how to interpret DNT signals, and we do not respond to DNT signals at this time. Regardless of any DNT signal, you may exercise your privacy rights as described in our Privacy Policy and as described in this Cookie Policy.

A current inventory of the specific Cookies and Similar Technologies used on the Services, including their names, providers, purposes, and durations, is available through our consent management platform, accessible through the "Cookie Preferences" (or similar) link in the footer of our marketing site.

We update this inventory from time to time. Because the inventory is generated and maintained by our consent management platform, it may be updated more frequently than this Cookie Policy.

8. Children

The Services are intended for Users who are at least eighteen (18) years of age. We do not knowingly use Cookies or Similar Technologies to collect personal information from individuals under eighteen (18). For more information, see Section 16 (Children's Privacy) of our Privacy Policy.

9. International Users

The legal requirements applicable to Cookies and Similar Technologies vary by jurisdiction. We seek to comply with applicable laws in each jurisdiction in which we operate, including:

(a) the EU General Data Protection Regulation, the EU ePrivacy Directive (and national implementing laws), and applicable European Economic Area national laws; (b) the UK Data Protection Act 2018, the UK GDPR, and the Privacy and Electronic Communications Regulations 2003; (c) the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and the California Online Privacy Protection Act; (d) the Utah Consumer Privacy Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Virginia Consumer Data Protection Act, and analogous laws in other U.S. states; and (e) such other laws as may apply in jurisdictions where the Services are offered.

By using the Services, you agree that your information may be transferred to and processed in jurisdictions that may have data protection laws different from those of your jurisdiction, as further described in Section 12 (International Data Transfers) of our Privacy Policy.

We may update this Cookie Policy from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this Cookie Policy and, where required by applicable law, by providing additional notice (such as through a banner on the Services or by email). Non-material changes (such as the addition or removal of specific Cookies that fit within an existing category) may be reflected in our cookie inventory and consent management platform without separate notice.

Your continued use of the Services after the effective date of any update to this Cookie Policy constitutes your acceptance of the updated Cookie Policy.
